Gary L. & Maxine L. Morris Special Use Permit Request
I. Summary of Request
The Morris’ request a Special Use Permit, with possible conditions,
to construct a detached private garage in excess of 850 square feet in area and
16 feet in height in Agriculture (A-1).
II. Location
The subject parcel is located at 3750 Surface Road in Union Valley
Estates in the Riner Magisterial District. All surrounding property is zoned Agriculture
(A-1) (see attached map).
III. Impacts
The proposed 1,232 square foot garage should have no negative impacts
on adjacent properties provided it is constructed in a style that is in keeping
with the character of the neighborhood and is not used for commercial purposes.
The existing dwelling on the property is new constructed and is 2,575 square feet
in area. The garage will be approximately twenty-one (21) feet in height, have limited
plumbing facilities for a small bathroom, and the exterior will resemble the house.
Electricity will be provided from the service that currently serves the existing
home. There should be no additional traffic from this use.
IV. Comprehensive Plan
The property lies in an area designated as Rural Expansion in the
Comprehensive Plan. The property is currently zoned Agriculture (A-1) and there
is no proposed change to the zoning of this property. Therefore, this request complies
with the Comprehensive Plan.
V. Analysis
This request is due to the recent revisions to the zoning ordinance
adopted in June 2001 that requires a Special Use Permit for any detached structure
that exceeds 850 square feet in area and 16 feet in height. This revision was implemented
to help the County gain some control over the illegal construction and use of garages
for commercial or industrial uses. This proposed garage is in a rural residential
area and is intended for the housing and maintenance of no more than three (3) antique
vehicles, garden tractor, garden plow, various garden tools and provide general
storage. The impacts of this proposed use should have no adverse effect on the surrounding
property owners or the character of the neighborhood.
VI. Staff Recommendation
The staff's preliminary recommendation is for approval of the Special
Use Permit for a private garage that exceeds 850 square feet in area and 16 feet
in height. The applicant can offer proffered conditions to limit any potential impacts
to the surrounding landowners that could help alleviate any objections from neighboring
property owners that may be present. No proffers have been submitted as of the date
of this report. In addition, the Planning Commission and Board of Supervisors can
impose any additional restrictions that they feel necessary to govern the use permitted
under the SUP. Staff offers the following conditions for consideration by the Board
and Commission:
- Private garage shall not exceed 1,232 square feet in area and 21 feet in total
height.
- Garage shall be private and not used for any work of a commercial nature.
This office has received no telephone calls inquiring about this
request; however adjacent property owners or other interested parties may be present
at the public hearing to present their views on this request.
