Tena Price (Agent: Sharon C. Karr) Rezoning Request
I. Nature of Request
Tena Price and her sister Sharon Karr are requesting to rezone a 1.943 acre tract
from Agriculture (A-1) to Residential (R-3) with a Special Use Permit to allow
for the existing mobile home.
The request is being made to allow for the settlement of the estate of the mother,
Yvonne Price. The lot will be subdivided, so that each daughter will have one
lot with a single family dwelling. Under the current (A-1) zoning classification,
the lot can not be subdivided due to the minimum 1.0 acre lot size.
II. Location
The subject parcel is located at the southwest corner of the intersection of
Merrimac Road (Rte. 657) and Oilwell Road (Rte. 824). The property is bordered
to the North by Oilwell Road. Across Oilwell Road is part of the Merrimac Pentecostal
Holiness Church property that is zoned General Business (GB). All other adjacent
property contains single-family dwellings and manufactured homes on property zoned
Agriculture (A-1). Surrounding properties to the North and East, include Warm
Hearth Retirement Community (Zoned RM-1) and Oak Forest Mobile Home Park (zoned
PMR with SUP). In addition, there are properties to the West and South that are
zoned Residential R-1, R-2, and R-3 (see attached map). All other surrounding
properties are zoned Agriculture (A-1).
III. Impacts
This rezoning should have no impacts on the surrounding land uses. No change
to existing conditions is proposed. It is possible that the lot could be further
subdivided if rezoned. In addition, no proffered conditions have been offered
as of the date of this report, so all permitted uses in the Residential (R-3)
zoning district could be built in the future.
IV. Comprehensive Plan
The property lies in an area designated as Urban Expansion in the 1990 Montgomery
County Comprehensive Plan. The property is currently served by public water and
sewer. Accordingly, this request complies with the comprehensive plan.
V. Analysis
This request is being made to help settle the estate of Yvonne L. Price and allow
for the subdivision of the property into two parcels. This request will have no
significant impact on the surrounding land uses because there is no proposed change
in the use of the property. However, rezoning to R-3 would allow such uses as
schools, duplexes and libraries "by-right". Concerns over these potential impacts
of these uses can be addressed through proffered conditions.
The applicant is also requesting a Special Use Permit to allow for the existing
manufactured home and any replacement of the house in the future.
VI. Staff Recommendation
Staff's preliminary recommendation is to approve the rezoning request with the
Special Use Permit for Manufactured Home, Class A or B.
Staff has received one telephone call from a neighbor who is concerned about
access to the property. Other property owners may be present at the public hearing
to express their views concerning this request.
