AT A REGULAR MEETING OF THE MONTGOMERY COUNTY PLANNING COMMISSION HELD ON JANUARY 12. 2000 IN COURTROOM B, THIRD FLOOR, COUNTY COURTHOUSE, CHRISTIANSBURG, VIRGINIA:

CALL TO ORDER:

Mr. Martin, Chair, called the meeting to order. Don Linkous, Secretary, established the presence of a quorum.

PUBLIC HEARING:

Kathleen Stewart (Agent: Anderson & Associates, Inc. Special Use Permit Amendment: (Planning Commission Decision)

Mr. Martin opened the public hearing on the Kathleen Stewart (Agent: Anderson & Associates, Inc.) Special Use Permit Amendment. He stated that Kathleen Stewart requested a Special Use Permit amendment to allow a Professional Office served by a septic system. Property is located at the Northeast corner of Barn Road and Route 177 Intersection in the Riner Magisterial District. The property lies in an area designated residential in the Comprehensive Plan.

Kelly Boyers, showed a video of the area.

Tom Roberts and Chris Workman, Anderson & Associates, made presentations to the Commission on the Stewart request. Mr. Roberts said Mark and Kathleen Stewart plan to build three medical offices on their property. They are asking for permission to continue using a septic system temporarily for the first building. Once the second office building is constructed, they plan to connect to public water and sewer for the first and second building. If someone else extends water and sewer lines near the property before they construct the second office building, they would also be glad to connect.

Mr. Martin asked for comments from the Planning Commission.

Mr. Elgin inquired about the drainfields and disposal of medical waste. Mr. Roberts stated that Health Department guidelines would be followed and there would be no disposal of medical waste.

Mr. Neumann asked where the location of the first building would be? Mr. Roberts stated that the first building would be constructed closest to Tyler Avenue.

Mr. Martin asked for comments in favor or opposition to the request from the public.

Mr. Bob Mitchell, 3434 Tyler Road, expressed his concern over the water and sewer issue. He thought the problems with sewage should be resolved before there is any more building around the hospital.

There being no further comments, Mr. Martin closed the public hearing on the Kathleen Stewart Special Use Permit amendment request.

Quorum Holding Company (Agent: Christopher Tuck) Special Use Permit Request: (Planning Commission Decision)

Mr. Martin opened the public hearing on the Quorum Holding Company (Agent: Christopher Tuck) Special Use Permit request. Mr. Martin stated that Quorum Holding Company (Agent: Christopher Tuck) requested a Special Use Permit to allow performance space for community theater. Property is located at 805 Triangle Street in the Price's Fork Magisterial District. The property lies in an area designated commercial in the Comprehensive Plan.

Mr. Christopher Tuck addressed the Commission on the request. His law office is next to the building to be renovated for the community theater.

Mr. Martin asked for comments from the Commission.

Mr. Elgin asked about the gutting of the building. Mr. Tuck explained how the walls would be designed and stated that most of the remodeling would be done by the playmakers. No load-bearing walls would be affected and all work would be done according to code.

Mr. Martin asked for comments in favor or opposition to the request from the public.

Quorum Holding Company (Agent: Bill Tuck/Trula Tuck) Special Use Permit Request: (Planning Commission Decision)

Mr. Martin opened the public hearing on the Quorum Holding Company (Agent: Bill Tuck/Trula Tuck) Special Use Permit request. Mr. Martin stated that Quorum Holding Company (Agent: Bill Tuck/Trula Tuck) requested a Special Use Permit to allow mini-warehouses. Property is located at 3956 South Main Street in the Price's Fork Magisterial District. The property lies in an area designated commercial in the Comprehensive Plan.

Kelly Boyers showed a video of the area.

Trula Tuck explained the project to the Commission. She showed a plat of the area and stated that 95% of the rough grading had been done.

Mr. Martin asked for comments from the Commission.

Mr. Daub expressed concern over the entrance way along a steep bank and may require a retaining wall with the adjoining property to the north. Ms. Tuck stated there would be no encroachment on the neighbors. Mr. Elgin expressed concern over the grade of the entrance road from Route 460 to the lot. He said that there is not a shallow enough slope. Ms. Tuck said the grade will be cut down and it will be easy to serve the units

Mr. Martin asked for comments in favor or opposition to the request from the public.

There being no comments, Mr. Martin closed the public hearing on the Quorum Holding Company (Agent: Bill Tuck/Trula Tuck) Special Use Permit.

PUBLIC ADDRESS:

Mr. Martin opened the Public Address session.

There being no comments from the public, Mr. Martin closed the Public Address session.

Mr. Martin welcomed Mr. John Muffo, Board of Supervisors, as Planning Commission Liaison.

APPROVAL OF AGENDA:

On motion by Ray Alcorn, seconded by Malvin Wells and unanimously carried, the agenda was approved as distributed.

OLD BUSINESS:

Kathleen Stewart (Agent: Anderson & Associates, Inc.) Special Use Permit amendment request.

Mr. Alcorn said he is not a big fan of every development having public sewer. He said in his mind, a septic system is not a bad thing. He said he does support the request. Further discussion followed concerning the current problems with public sewer in the 177 Corridor. Mr. Neumann felt these problems should be addressed before additional construction proceeds on the south side of the interstate.

On motion by Ray Alcorn, seconded by Don Linkous and carried by a vote of 7 - 1 (Harry Neumann, opposing), the Kathleen Stewart (Agent: Anderson & Associates, Inc.) request for a Special Use Permit amendment; (Tax Parcel Nos. 104-A-27A, 104-A-28, 104-4-46) to allow a Professional Office served by private well and septic system is found to be compatible with the Comprehensive Plan and recommended to the Board of Supervisors for approval with the addition of the following new condition to the existing Special Use Permit.

  1. The southern new building (8,010 square feet) may be constructed and served by a private well and septic system approved by the Health Department provided that the southern new building connects to public water and sewer either (1) at the time a second new building is constructed on the property or (2) at the time public water and sewer is available on Barn Road, whichever occurs first.

Property is located at the Northeast corner of Barn Road and Route 177 Intersection in the Riner Magisterial District. The property lies in an area designated residential in the Comprehensive Plan.

Quorum Holding Company (Agent: Christopher Tuck) Special Use Permit Request:

Mr. Neumann asked if there was a requirement for a sprinkler system in the building? Mr. Powers stated that the development would have to meet the building code. Mr. Tuck stated that the Fire Marshal has said that a sprinkler system will not be required.

On motion by Ray Alcorn, seconded by Don Linkous and unanimously carried, the Quorum Holding Company (Agent: Christopher Tuck) request for a Special Use Permit; (Tax Parcel No. 067-A75) to allow performance space for community theater is found to be compatible with the Comprehensive Plan and recommended to the Board of Supervisors for approval subject to the following six conditions:

  1. This permit is to allow use of present building and parking area for theater purposes. In accordance with the provisions of the zoning ordinance, this permit will automatically become void if use does not take place within two years.
  2. Use of this property and parking area for theater purposes shall be limited to non-business hours (times other than 8:00 a.m. to 5:00 p.m. Monday through Friday).
  3. The current building shall be substantially improved in accordance with Montgomery County Building Codes for theater use.
  4. The lessee shall be responsible for the provision of sufficient parking. They shall not allow parking on adjacent properties unless an agreement is made.
  5. No performances shall be held until the Building Official certifies that the structure meets all building code requirements for a theater.
  6. No performances shall be held until the parking area is lined as per the provided map.

Property is located at 805 Triangle Street in the Price's Fork Magisterial District. The property lies in an area designated commercial in the Comprehensive Plan.

Quorum Holding Company (Agent: Bill Tuck/Trula Tuck) Special Use Permit Request:

Mr. Alcorn asked about the entrance onto Route 460. Ms. Tuck stated that they will be putting in a new entrance and have the approval from VDOT for the turn lane.

On motion by Ray Alcorn, seconded by Don Linkous and carried by a vote of 7-1 (Charlie Elgin, opposing), the Quorum Holding Company (Agent: Bill Tuck/Trula Tuck) request for a Special Use Permit (Tax Parcel No. 67-5-6) to allow mini-warehouses is found to be compatible with the Comprehensive Plan and recommended to the Board of Supervisors for approval subject to the following three conditions:

  1. This permit is to allow construction of mini-warehouses (self storage units). In accordance with the provisions of the zoning ordinance, this permit will automatically become void if substantial construction does not take place within two years.
  2. Construction shall be substantially in accordance with the site plan.
  3. All driveways shall be hard surfaced (prime and double-seal, or asphalt pavement).

Property is located at 3956 South Main Street in the Price's Fork Magisterial District. The property lies in an area designated commercial in the Comprehensive Plan.

Ms. Dorsett distributed copies of the Sliding Scale and Signage handouts explaining the requirements of the new Zoning Ordinance to Commission members for their review.
