AT A REGULAR MEETING OF THE MONTGOMERY COUNTY PLANNING COMMISSION HELD ON DECEMBER 8, 1999 IN COURTROOM B, THIRD FLOOR, COUNTY COURTHOUSE, CHRISTIANSBURG, VIRGINIA:

CALL TO ORDER:

Mr. Wells, Chair, called the meeting to order. Kathryn Brennan, Secretary, established the presence of a quorum.

PUBLIC HEARING:

2232 Review - New Elliston Fire Station

Mr. Wells opened the public hearing on the 2232 Review - New Elliston Fire Station.

Mr. Wells stated that he was associated with the Elliston Fire Station and very pleased with the 2232 Review for Montgomery County's plans for a new station located at the Elliston-Lafayette Industrial Park.

Mr. Wells asked for anyone to speak. No one spoke so Mr. Wells closed the Public Hearing on the 2232 Review - New Elliston Fire Station.

PUBLIC ADDRESS:

Mr. Wells opened the Public Address session.

Elvan Peed, 3677 Laurel Drive expressed his concern about the proximity of the proposed street to his property and home in the Laurel Ridge subdivision. He said he does not object to the development of this property next to his lot provided it is done in a responsible manner and does not result any negative impacts on the subdivision and his property.

Cheryl Peed expressed her concern over the development of the property next to their lot.

Roger Avery, 3673 Laurel Drive stated the he supported Mr. Peed on his comments.

There being no other speakers, Mr. Wells closed the Public Address session.

APPROVAL OF AGENDA:

On motion by Richard Daub, seconded by Joe Draper and unanimously carried, the agenda was approved as distributed.

OLD BUSINESS:

2232 Review - New Elliston Fire Station:

Members discussed the 2232 Review - New Elliston Fire Station.

On motion by Joe Draper, seconded by Jim Martin and unanimously carried, the 2232 Review - New Elliston Fire Station is approved as being substantially in accord with the Comprehensive Plan.

Brush Mountain West Phase 6 - Final Plat:

Mr. Powers reviewed the revised Brush Mountain West Phase 6 Subdivision Final Plat and the proposed draft conditions. Discussion followed. Mr. Elgin expressed his concern over the cul-de-sacs being too small for fire truck and snow plows. Mr. Powers stated that the Virginia Department of Transportatoin (VDOT) would be sure that all standards are met before approving their construction plans for streets and drainage.

Randall Hancock, Draper-Aden Associates made his presentation to the Commission. Mr. Alcorn stated that this development is a by-right development and would need work with the engineers. Further discussion followed.

On motion by Ray Alcorn, seconded by Richard Daub and carried by a vote of 8-0 (Joe Draper, Harry Neumann, abstaining) the Final Plat of Brush Mountain Estates, Phase 6 (lots #30 through #49; Draper Aden Associates Plan No. T-7557-J dated October 27, 1999) is approved subject to recordation within 6 months (i.e. until June 8, 2000) and to the following conditions:

  1. Construction plans for streets and drainage shall be reviewed and approved by the Virginia Department of Transportation (VDOT).
  2. Drainage easements shall be secured on adjoining properties that extend to an
  3. established watercourse.

  4. Provision for individual septic systems for each lot shall be reviewed and approved by the Montgomery County Health Department.
  5. Power lines, telephone lines and other public utilities shall satisfy the requirement for underground utilities (Section 8-155(a).
  6. An erosion & sediment control plan shall be reviewed and approved by the County Engineer
  7. 6. If stormwater detention facilities are necessary, then a Homeowner's Association shall

    be established. The Homeowner's Association shall be responsible for maintenance

    and liability of all such facilities. The County Attorney shall approve the Covenants,

    Conditions and Restrictions and the associated By-Laws of the Homeowner's

    Association.

  8. New street names shall be approved by the Planning Department.

Brush Mountain West Phases 5, 7, 8 and 9 - Preliminary Plat:

Mr. Hancock, Draper-Aden Associates, addressed the Commission of the Brush Mountain West Phases 5, 7, 8 and 9 Preliminary Plat. He stated that their Geologist had surveyed the area concerning the mining activities. One mine had been located in Phase 8 and 10. Evidence of one shaft still open. The plat will show these elevations. Mr. Hancock stated that drilling will be done to determine that there is nothing on the road where a house is to be constructed.

Discussion followed concerning mines and shafts, cul-de-sacs, topography, water run off and sink holes. Mr. Hancock stated that they would have to abide by the Erosion & Sediment Control Plan that will be approved by the County. Members reviewed the proposed draft conditions.

On motion by Ray Alcorn, seconded by Kathryn Brennan and carried by a vote of 9-0 (Joe Draper, abstaining ) the Preliminary Plat of Brush Mountain West, Phases 5, 7, 8 & 9 (lots #28, #29 and #50 through #95); Draper Aden Associates Plan No. T-7557-01P dated December 1, 1999) is for one year (i.e. until December 8, 2000) subject to the following conditions:

  1. Construction plans for streets and drainage shall be reviewed and approved by the Virginia Department of Transportation (VDOT).
  2. Drainage easements shall be secured on adjoining properties that extend to an established watercourse.
  3. Dead-end streets shall serve no more than 35 dwelling units.
  4.  

  5. Provision for individual septic systems for each lot shall be reviewed and approved by the Montgomery County Health Department.
  6. Power lines, telephone lines and other public utilities shall satisfy the requirement for underground utilities (Section 8-155(a).
  7.  

  8. An erosion & sediment control plan shall be reviewed and approved by the County Engineer

be established. The Homeowner's Association shall be responsible for maintenance

8. Planning Commission shall review and approve each Final Plat. At the time of Final

Plat review, increased rear setbacks shall be considered for any lots backing onto

Laurel Ridge lots #85, #86 and #87.

9. New street names shall be approved by the Planning Department.

Windy Ridge - Final Plat:

Michael Gay, Gay Engineering, addressed the Commission on the Windy Ridge - Final Plat. He reviewed the revised Site Development Plan and revised Subdivision Plat. He said the proposed Subdivision is in Montgomery County with Town of Blacksburg water and sewer service to the project. Mr. Alcorn asked what the Town of Blacksburg had reviewed? Mr. Gay said the water and sewer and Final Plat.

On motion by Ray Alcorn, seconded by Joe Draper and unanimously carried, the Windy Ridge Final Plat was approved.

There being no further business, the meeting was adjourned at 8:00 p.m.
