AT A REGULAR MEETING OF THE MONTGOMERY COUNTY PLANNING COMMISSION
HELD ON OCTOBER 14, 1998 IN COURTROOM B, THIRD FLOOR, COUNTY COURTHOUSE, CHRISTIANSBURG,

CALL TO ORDER:
Mr. Wells, Chair, called the meeting to order and Ms. Brennan, Secretary, established the presence of a quorum.

PUBLIC HEARING:
Timothy McCoy Special Use Permit:
Mr. Wells opened the public hearing on the Timothy McCoy Special Use Permit Request.
Kimberly Golden showed a video of the area and made a presentation of the request.
Tim McCoy, Applicant, stated that he wishes to operate an auto repair shop in an existing two-bay garage.
Mr. Wells asked for comments from the public.
Mr. Tim McCoy, Father, spoke in favor of the request. He said he is an adjoining property owner and he feels this is an asset to the community.
Jeffrey Dalton Đ adjacent property owner, said he supports the request. He said the community needs the auto mechanic. He said Mr. McCoy maintains a clean garage and keeps the surrounding property clean. Mr. Dalton said the garage is not a detriment to his property.
There being no further comments from the public, Mr. Wells closed the public hearing on the Timothy McCoy Special Use Permit request.
Richard Duffner (Agent: Thompson Chrysler Plymouth, Inc.) Rezoning Request:
Kimberly Golden showed a video of the area and made a presentation of the request.
Jackelyn Earnest Watson, Thompson Chrysler Plymouth, Inc., stated that Mr. Duffner wishes to expand the automobile dealership. She said there are presently no plans to build on the parcels for which rezoning is sought. Rather, the parcels will be used for additional parking space and the existing dwelling unit will be used for storage.
There being no further comments, Mr. Wells closed the public hearing on the Richard Duffner (Agent: Thompson Chrysler Plymouth, Inc.) rezoning request.
Comprehensive Plan Map Amendment/Belview Urban Expansion Area:
Ms. Golden made a presentation on the results of the 2232 Review/Belview Sewer Project in compliance with the text but not the map. She showed a video of the area. Discussion followed.
There being no comments from the public, Mr. Wells closed the public hearing on the Comprehensive Plan Map Amendment/Belview Urban Expansion Area.

Mr. Wells opened the public address session. There being no comments from the public, Mr. Wells closed the public address session.
APPROVAL OF AGENDA:
On motion by Don Linkous, seconded by Ray Alcorn and unanimously carried, the agenda was approved as amended. Comprehensive Plan Map Amendment/Belview Urban Expansion Area was added under Old Business. Kitty Brennan report on Virginia Institute Planning CommissionerŐs Conference, William P. Matthews Conditional Use Permit requests and Mary Biggs, Board of Supervisors, report were added under New Business.
OLD BUSINESS:
Timothy McCoy Special Use Permit:
Members discussed the request.
On motion by Joe Draper, seconded by Ray Alcorn and unanimously carried, the Timothy W. McCoy request for a Special Use Permit for Tax Parcel No. 49-2-7A to allow an auto repair shop is found to be compatible with the Comprehensive Plan and recommended to the Board of Supervisors for approval subject to the following conditions:
- This permit authorizes the operation of an auto repair shop. In accordance with the provisions of the zoning ordinance, this permit shall automatically expire if the business ceases to operate for a period of two years or more.
- The applicant shall obtain a commercial entrance permit from the Virginia Department of Transportation and shall provide a copy to the Zoning Administrator.
- Waste oil and solvents shall be property stored and disposed of according to state and federal requirements.
- Hours of operation shall be limited to 7:00 AM to 8:00 PM, Monday through Saturday.
- All repair work shall be conducted inside the building.
- No more than fifteen vehicles shall be parked on the property.

Mr. Alcorn asks if another entrance would be provided? Ms. Watson stated that another entrance could be built but they will presently use the current entrance. Mr. Scott stated that if a commercial entrance were required by Virginia Department of Highways (VDOT), the current entrance would be closed.
On motion by Don Linkous, seconded by Kitty Brennan and unanimously carried, the Richard Duffner (Agent: Thompson Chrysler Plymouth, Inc.) request to rezone .34 acres, Tax Parcel No. 090-5-6 and Tax Parcel No. 090-5-40A, from A-1 (Agriculture) to GB (General Business) is found to be compatible with the Comprehensive Plan and recommended to the Board of Supervisors for approval. Property is located at 1523 Testerman Drive in the Riner Magisterial District.
Comprehensive Plan Map Amendment/Belview Urban Expansion Area:
Members discussed the map amendment to enlarge the Belview Urban Expansion Area.
On motion by Joe Draper, seconded by Ed Green and unanimously carried, the Plan Map Amendment to enlarge the Belview Urban Expansion Area to include the entire project area and is recommended to the Board of Supervisors for approval.
Styne Proposed Subdivision:
Don Rainey, Rainey Engineering, made a presentation on the Bob and Julie Styne proposed subdivision. He said he was working with Anderson & Associations on a plan for a residential subdivision in Riner. He explained the graphics, terrain, and public utilities for the area.
Tom Roberts, Anderson and Associates, was present to answer questions.
Discussion followed. Mr. Daub asked about the proposed road easement to Five Points Road? Mr. Powers stated that the right-of-way will be dedicated but the road will not be built until sometime in the future. Ms. Brennan expressed concern over the exit onto Union Valley Road, which is very dangerous. Mr. Green asked what the build out time would be. Mr. Rainey stated approximately ten years, depending on the market. Mr. Neumann asked about access to adjoining properties. Should the Planning Commission require the dedication of additional right-of-way? This issue will be evaluated further.
NEW BUSINESS:
William P. Matthews Conditional Use Permit Requests:
Discussion began on the William P. Matthews request to the Town of Christiansburg for a 1) Conditional Use Permit to allow contractor equipment storage and 2) Conditional Use Permit to allow Multi-Family residences off Laurel Street.
Both requests were discussed and members decided that their concern was that new land uses should be compatible with the existing commercial investment in the Marketplace/Arbor View area. They also expressed concern about traffic safety since this property does not front on a public street.
On motion by Ray Alcorn, seconded by Harry Neumann and unanimously carried, a recommendation was made that staff submit commissionŐs comments to the Town of Christiansburg on the William P. Matthews two Conditional Use Permit requests.
Virginia Institute Planning CommissionerŐs Conference:
Ms. Brennan gave a report on the Planning CommissionerŐs conference that she attended in Richmond. She stated that designing around certain land features and golf course development were several items discussed at their conference. She stated that a good Comprehensive Plan is needed as the proper way to say no to rezoning and to development. She said it was discussed that spot zoning is illegal when it is for a private benefit and not for the good of the community. Ms. Brennan stated that this was a wonderful conference.
Ms. Biggs made comment that Mr. Gorman, Chairman Board of Supervisors has expressed concern over the animal ordinance as it relates to the revised Zoning Ordinance.
