AT A REGULAR MEETING OF THE MONTGOMERY COUNTY PLANNING COMMISSION HELD ON SEPTEMBER 9, 1998 IN COURTROOM B, THIRD FLOOR, COUNTY COURTHOUSE, CHRISTIANSBURG, VIRGINIA:

CALL TO ORDER:

Mr. Wells, Chair, called the meeting to order and Ms. Brennan, Secretary, established the presence of a quorum.

PUBLIC HEARING:

Paul & Rebecca Underwood Rezoning Request:

Mr. Wells opened the public hearing on the Paul & Rebecca Underwood Rezoning Request.

Paul Underwood, Applicant, addressed the Commission on his rezoning request. He stated that he owns a 21.0178 acre parcel of land on Lovely Mount Drive, zoned A-1 (Agriculture). He stated that this land is part of an estate he purchased. He wishes to subdivide the property for residential use and has applied to rezone it to R-1 (Residential). He said he plans to divide the property into four lots of approximately five acres each. Mr. Underwood stated that he has a problem with this request not being in compliance with the Comprehensive Plan. He said he does not want high density uses on his property. He plans to have only one house permitted on each lot and no mobile homes.

Mr. Powers stated that this area is within the Rte. 177 Corridor Overlay District. Within the Overlay, subdivisions are not permitted in the A-1 District, thus the request to rezone to residential. Mr. Powers said that since this property lies within the Rte. 177/Tyler Avenue Corridor Area, it is subject to the Joint Comprehensive Plan that the County and the City of Radford have adopted for this area which designates this property for "high intensity" uses.

Mr. Wells asked for comments from the public.

Mr. Mark Stewart, 2875 Barn Road, spoke in favor of the Underwood request. He said he and his wife see no problem in granting this request.

Cheryl Lamascolo, 2340 Wintergreen Drive, spoke in favor of the Underwood request. She said they bought the property next to the Underwoods and nothing was mentioned about high intensity development.

Jim Morrison, 1242 Lovely Mount Drive, spoke in favor of the Underwood request. He stated that his land has been in his family for 100 years. He may want to sell off small lots but he does not intend to have high intensity uses on his property.

Steve Bodtke, Real Estate Agent, spoke in favor of the Underwood request. He stated that the members of the Planning Commission should go out and look at the Underwood property instead of viewing it on video. He said any future development would be large lot development. Mr. Powers ask Mr. Bodtke if high intensity designation in the 177 Corridor was explained to all buyers of their property. Mr. Bodtke stated that this was covered in the listing.

There being no further comments, Mr. Wells closed the public hearing on the Paul and Rebecca Underwood rezoning request.

Quorum Holding Corporation Rezoning Request:

Mr. Wells opened the public hearing on the Quorum Holding Corporation Rezoning Request.

Mr. Davis showed a video of the area.

Ms. Trula Tuck, applicant, addressed the Commission. She stated that Quorum Holding Corporation own a four-acre lot fronting on Rte. 460. Part of the property is zoned GB (General Business). The rear portion is zoned A-1 (Agriculture). They would like to have the entire property zoned GB (General Business).

There being no speakers, Mr. Wells closed the public hearing on the Quorum Holding Corporation rezoning request.

PUBLIC ADDRESS:

Mr. Wells opened the public address session.

Mr. Stewart addressed the Commission again on the Paul & Rebecca Underwood rezoning request. He supports the Underwood request. He said he had received correspondence from Mr. Asbury, City Manager, Radford. Mr. Stewart asked that the Commission go forward with this request.

APPROVAL OF AGENDA:

On motion by Ed Green, seconded by Don Linkous and unanimously carried, the agenda was approved as amended. 2232 Review/Christiansburg Wastewater Treatment Facility Expansion/Upgrade and 2232 Review Policy were added under New Business.

OLD BUSINESS:

Paul & Rebecca Underwood Rezoning Request:

Mr. Wells stated that he could support this request if the Comprehensive Plan is amended. Ms. Brennan asked if City of Radford will be involved in the amending of the Comprehensive Plan? Mr. Scott stated that they would. In order to make any changes, Radford will have to be in agreement. Mr. Linkous stated that the area needs to be designated properly. Mr. Draper said the Board of Supervisors cannot approve this request if the Planning Commission recommendation does not state that it is compatible with the Comprehensive Plan. Ms. Brennan said the Commission needs to get opinions on this request from the Radford Planning Commission.

On motion by Joe Draper, seconded by Don Linkous and unanimously carried, the Paul E. & Rebecca B. Underwood request to rezone 20 acres; Tax Parcel No. 289.56 from A-1 (Agriculture) to R-1 (Residential) is tabled until the next Regular Planning Commission meeting with the City of Radford on September 16th. Property is located on Lovely Mt. Drive.

Quorum Holding Corporation Rezoning Request:

On motion by Don Linkous, seconded by Joe Draper and unanimously carried, the Quorum Holding Corporation request to rezone approximately two acres from A-1 (Agriculture) to GB (General Business) is recommended to the Board of Supervisors for approval provided the following condition is proffered by the applicant:

Within ninety (90) days after the approval of this rezoning request, a commercial entrance that meets all requirements of the Virginia Department of Transportation shall be constructed to serve this property.

Property is the rear portion of Tax Parcel No. 67-4-6, located at 3956 South Main Street, in the PriceÕs Fork Magisterial District.

Montgomery County PSA Subdivision Variance Request:

Mr. Davis showed a video of the area and reviewed the Subdivision Variance Request Analysis Report.

Mr. Don Todora, Public Service Authority (PSA), spoke. He stated that the PSA wishes to create a lot without road frontage. The lot will have an existing water tank located on it. He stated that PSA will abide by all conditions. Discussion followed.

On motion by Kitty Brennan, seconded by Ed Green and unanimously carried, the Montgomery County Public Service Authority variance request from Section 8-151 of the Subdivision Ordinance in order to create a lot without road frontage is recommended to the Board of Supervisors for approval subject to the following conditions:

1. No dwellings are allowed on the new lot until required road frontage is public.

2. The water tank continues to be painted with a neutral color that blends with the

surrounding area.

3. The recorded plat for the new lot notes the detains of this variance and its condition.

Orchards Phase 11B - Access Plan:

Mr. Powers distributed copies of the plat for Commission members to review. He explained the prior approval of the plat with private streets. He said neither Virginia Department of Highways (VDOT) or the county will have to maintain the developed streets. Mr. Rick Whitney, Developer, was present to answer questions. Mr. Wells asked if the plat meets all the requirements? Mr. Powers stated that it does. Mr. Green asked if school buses would travel the private streets. Mr. Powers stated that they would not but buses would travel onto nearby Cherry Lane which is a public street.

On motion by Don Linkous, seconded by Ed Green and unanimously carried (Joe Draper, abstaining), the Orchards Phase II B- Access Plan is recommended to the Board of Supervisors for approval.

NEW BUSINESS:

2232 Review/Christiansburg Sewerage Pump Station:

Mr. Barry Helms, Christiansburg Assistant Town Manager, addressed the Commission on the Sewerage Pump Station and distributed copies of the maps explaining the location of the pump station to serve the eastern portion of the Town. The property is between 4575 and 4802 Wayside Drive.

2232 Review/ChristiansburgWater Storage Tank:

Mr. Helms explained that the Town of Christiansburg is planning to build a water storage tank to serve the Falling Branch Industrial Park.

2232 Review/Christiansburg Wastewater Treatment Facility Expansion/Upgrade:

Mr. Doug Hudgins, Project Engineer, Olver, Inc., addressed the Commission on the Wastewater Treatment Facility Expansion/Upgrade. He explained that the proposed expansion would upgrade the facility from 4.0 MGD to 8.0 MGD. The facility is located off Rt. 660 on Crab Creek. Discussion followed on all three reviews.

On motion by Joe Draper, seconded by Michael Ewing and unanimously carried (Jim Martin, abstaining), the 2232 Review/Christiansburg Sewerage Pump Station on Wayside Drive, the 2232 Review/Christiansburg Water Storage Tank for Falling Branch Industrial Park and the 2232 Review/Christiansburg Wastewater Treatment Facility Expansion/Upgrade on Crab Creek are approved as being substantially in accord with the Comprehensive Plan.

2232 Review/Belview Sewer Project:

Kimberly Golden distributed copies of the Staff Analysis-2232 Review/Belview Sewer Project to Commission members for their review. Mr. Jerry Mabry, Utilities Engineer, explained that the project is intended to eliminate the problem of failing and marginal septic systems, which have been troublesome in the Dudley Village subdivision and the project will also facilitate the closure of a large lagoon system at MassieÕs Trailer Park. Ms. Golden reviewed the staff analysis. The project is substantially in accord with the Comprehensive Plan text but not with the map. After review of this map, members stated that a change should be made to the Comprehensive Plan map to enlarge the Belview Urban Expansion Area.

On motion by Harry Neumann, seconded by Don Linkous and unanimously carried, the 2232 Review/Belview Sewer Project is approved as being substantially in accord with the Comprehensive Plan Text. Further, a Comprehensive Plan map amendment to enlarge the Belview Urban Expansion Area to include the entire project area is scheduled for a public hearing on October 14, 1998.

2232 Review/Riner Water & Sewer Project:

Mr. Mabry addressed the Commission on the Riner Water & Sewer projects. He explained the area being served, connections, and with the water improvements, better fire protection can be provided. Discussion followed.

On motion by Joe Draper, seconded by Jim Martin and carried by a vote of 8-1 (Harry Neumann (opposing), the 2232 Review/Riner Water & Sewer Project is approved as being substantially in accord with the Comprehensive Plan.

2232 Review Policy:

Discussion followed regarding the 2232 Reviews being placed on the Consent Agenda when the projects are judged by staff to be routine in nature for approval at Planning Commission Regular Meetings. Mr. Linkous stated that he thought this would be worth trying.

1997 Subdivision Annual Report:

Mr. Ed Davis gave a report on the 1997 Subdivision Annual Report summarizing the subdivision activity in the County. He explained the table showing the results of the 1997 Subdivision Activity Analysis of New Lots.

Mr. Powers reminded the Commission that the next Planning Commission Regular Meeting with the Radford Planning Commission on September 16th will be held at the Health & Human Services Building on Pepper Street.

There being no further business, the meeting was adjourned at 8:45 P.M.
