AT A REGULAR MEETING OF THE MONTGOMERY COUNTY PLANNING COMMISSION
HELD ON JUNE 10, 1998 IN COURTROOM B, THIRD FLOOR, COUNTY COURTHOUSE, CHRISTIANSBURG,
VIRGINIA:
CALL TO ORDER:
Mr. Wells, Chair, called the meeting to order and Ms. Brennan, Secretary established the presence of a quorum.

PUBLIC HEARING:
Martha Orrick/Blue Eagle Partnership Rezoning Request:
Mr. Wells opened the public hearing on the Martha Orrick/Blue Eagle Partnership
rezoning request.
Mr. Davis showed a video of the area.
Mr. Wells asked for comments from the applicant.
Mr. Alan Gillis, Attorney, Mr. Louis Nash, U.S. Postal Service, Greensboro,
N.C. and Mr. Bob Christian, Postmaster, were present to address the commission
on the rezoning request.
Mr. Neumann expressed his concern over the increase in traffic. Mr. Nash
said there will only be two postal vehicles coming into the proposed post
office. One will come in at 5:00 A.M. and the other one will come in at 5:15
P.M. There will be 27 parking places for postal customers to park.
Discussion followed concerning limiting the use to a post office and prohibiting
any direct access onto Roanoke Road. Mr. Green expressed concern about the
width of State Route 745 and the possible effects of increased traffic on
the Fire Department across the street.
Mr. Wells asked for comments from the public.
Mr. Baron Pendleton expressed concern over the cemetery adjacent to the postal
property. He said he has family buried there. He takes care of the cemetery
and would like to know what buffering is planned between the proposed post
office and the cemetery.
Mr. Ray Epperly stated that there is a community need for a new post office
and he supports the rezoning request.
Mr. Nash stated that the post office will provide a screen of white pines
for a buffer between the post office and the cemetery.
There being no further comments from the public, Mr. Wells closed the public
hearing on the Orrick Family/Blue Eagle Partnership Rezoning Request.
Robert & Brenda Martin Special Use Permit Request:
Mr. Wells opened the public hearing on the Robert & Brenda Martin Special
Use Permit request.
Mr. Davis showed a video of the area.
Mr. Wells asked for comments from the applicant.
Mr. Martin stated that he planned to build two storage buildings on the lower
site of his property. He said the units would be approximately twenty feet
by eighty feet in size. He has the recommendation from Virginia Department
of Transportation (VDOT) on the entrance to the property.
Mr. Wells asked for comments from the public. No one was present to speak.
Mr. Wells closed the public hearing on the Robert & Brenda Martin Special
Use Permit request.
Montgomery County Planning Commission Rezoning Request:
Mr. Wells opened the public hearing on the Montgomery County Planning Commission
Rezoning request.
Mr. Davis presented a video of the map showing the boundary and explained
the areas of concern.
Mr. Wells asked for comments from the public.
Ms. Jessica Wilson, Old Town Road, stated that they would like to have the
homes in a historical district. They are in favor of single-family dwellings
but not multi-family.
Mr. Ray Epperly, spoke in opposition to rezoning his property. He raised
questions concerning the legality of the proposed rezoning. He recommended
that the County Attorney address this issue.
Mary Epperly presented a petition of 10 people who do not wish to have their
property rezoned.
Nancy Spangler stated that she wished to have her property left as is. She
does not wish to have it rezoned.
There being no further comments from the public, Mr. Wells closed the public
hearing on the Montgomery County Planning Commission Rezoning request.
Public Address:
Mr. Wells opened the public address session. There being no comments from
the public, the public address was closed.
APPROVAL OF AGENDA:
On motion by Ray Alcorn, seconded by Ed Green and unanimously carried,
the agenda was approved as amended. Orchard, Phase 11A Final Plat, Shelor
Farm, Phase 11 Final Plat and Turman Lumber Company Rezoning Request were
items added to the agenda.
Martha Orrick/Blue Eagle Partnership Rezoning Request:
On motion by Joe Draper, seconded by Ed Green and unanimously carried,
the Orrick Family/Blue Eagle Partnership request to rezone 1.0816 acre from
A-1 (Agriculture) to GB (General Business); Tax Parcel No. 59A-A-30 is found
to be compatible with the Comprehensive Plan and recommended to the Board
of Supervisors for approval subject to the applicant making the following
proffered conditions:
1. The property will be used only for a United States Post Office.
2. No direct access onto Roanoke Road shall be permitted.
Property is located at 9420 Roanoke Road, in the Shawsville Magisterial District.
Robert & Brenda Martin Special Use Permit Request:
On motion by Joe Draper, seconded by Don Linkous and unanimously carried,
the Robert and Brenda Martin request for a Special Use Permit to construct
mini-warehouses; Tax Parcel Nos. 60-1-4 and 4A is found to be compatible with
the Comprehensive Plan and recommended to the Board of Supervisors for approval
subject to the following conditions:
1.This permit is to allow construction of mini-warehouses (self-storage
units). In accordance with the provisions of the zoning ordinance, this
permit will automatically become void if substantial construction does not
take place within two years.
2.Construction shall be substantially in accordance with the site plan
date 4/14/98 (Plan S-1034, C.S. Correll).
3. All driveways shall be hard surfaced (prime and double-seal, or pavement).
Property is located at 9837 Roanoke Road, in the Shawsville Magisterial District.
Montgomery County Planning Commission Rezoning Request:
On motion by Joe Draper, seconded by Ed Green and carried by a vote of
6-2 (Ray Alcorn, Malvin Wells, opposing), the Montgomery County Planning Commission
request to rezone approximately 43 acres in the western area of Shawsville
from Agriculture (A-1) and General Business (GB) to Residential (R-1); Tax
Parcels Nos. 71-A-52, 53, 54, 54A, 55, 56, 57, 58, 58A, 59, and 72; 83C1-6-1, 2, 3, 6,
and B; and 83C1-A-63, 64, 65, 67, 68, 69, 74, 75, 76, 77, 78, 79, 80, 81, 82, and
83 is found to be compatible with the Comprehensive Plan and recommended to
the Board of Supervisors for approval subject to legal advice from the County
Attorney.
Property is located in the western area of Shawsville, between Roanoke Road
and the Norfolk Southern railroad tracks, in the Shawsville Magisterial District.
Turman Lumber Company Rezoning Request:
On motion by Don Linkous, seconded by Ed Green and unanimously carried,
the Turman Lumber Company rezoning request is removed from the table.
Mr. Scott reviewed a letter from Kitty Brennan concerning the Turman Lumber
Rezoning request and the concerns which need to be addressed and resolved.
She stated in her letter that if the commission decides that they desire to
see this area opened to further industrial development, then a change in the
Comprehensive Plan should be initiated.
Mr. Kendall Clay, Attorney, was present. He addressed Ms. Brennan’s concerns.
Discussion followed concerning the Acoustical Study and the traffic problems.
Mr. Clay stated that the school officials plan to give him a list of school
bus times this fall.
On motion by Ray Alcorn, seconded by Don Linkous and unanimously carried,
(Joe Draper, abstaining), the Turman Lumber Company request to rezone 19.659
acres; Tax Parcel No. 104-A-68, from A-1 (Agriculture) to M-1 (Industrial)
is tabled until a Comprehensive Plan Amendment is initiated and approved.
Property is located on Fire Tower Road, immediately north of the existing
Turman sawmill, in the Riner Magisterial District.
Orchard Phase 11A Final Plat:
Carolyn Fullerton, Draper-Aden Associates, was present to answer questions.
On motion by Ray Alcorn, seconded by Don Linkous and unanimously carried,
(Joe Draper, abstaining), the Orchard Phase 11A Final Plat is recommended
to the Board of Supervisors for approval.
Shelor Farms Phase 11 Final Plat:
On motion by Ray Alcorn, seconded by Don Linkous and carried by a vote
of 6-1 (Harry Neumann opposed, Joe Draper, abstaining), the Shelor Farms Phase
11 Final Plat is recommended to the Board of Supervisors for approval.
There being no further business, the meeting was adjourned
at 8:15 p.m.
