AT A REGULAR MEETING OF THE MONTGOMERY COUNTY PLANNING
COMMISSION HELD ON MAY 13, 1998 IN COURTROOM B, THIRD FLOOR,
COUNTY COURTHOUSE, CHRISTIANSBURG, VIRGINIA:
CALL TO ORDER:
Mr. Green, Vice- Chair, called the meeting to order and Ms. Brennan, Secretary,
established the presence of a quorum.

PUBLIC HEARING:
William M. Flinchum Rezoning & SUP Request:
Mr. Green opened the public hearing on the William M. Flinchum rezoning and
Special Use Permit request.
Mr. Davis showed a video of the area.
Mr. Blaine Keesee, Gay Engineering, agent, was present as well as Mr. Flinchum. Mr. Keesee stated that the rezoning request was not for expansion but only to allow the current usage of a building permit that was issued in 1985. He reviewed the anticipated proffers for the request.
Mr. Green asked for comments from the public.
No one was present to speak. Mr. Green closed the public hearing on the William
M. Flinchum Rezoning and SUP request.
Stratford Group, Inc. Rezoning Request:
Mr. Green opened the public hearing on the Stratford Group, Inc. rezoning
request.
Mr. Davis showed a video of the area.
The applicant was not present.
Mr. Green asked for comments from the public.
No one was present to speak. Mr. Green closed the public hearing on the
Stratford Group, Inc. rezoning request.
Falling Branch Comprehensive Plan Amendment:
Mr. Green opened the public hearing on the Falling Branch Comprehensive Plan
Amendment.
Mr. Davis showed a video of the area and summarized the locations of the
Plateau and Creek Areas in the Falling Branch Community.
Mr. Green asked for comments from the public.
Mr. Jack Via, property owner in the Falling Branch area, spoke. He stated that he
was very sensitive to how this amendment would affect his property from the Creek Area. He said that soil and erosion should be strictly enforced for future developments in this area.
There being no further comments, Mr. Green closed the public hearing on the
Falling Branch Comprehensive Plan Amendment.
PUBLIC ADDRESS:
Mr. Green opened the public address session.
Ms. Joy Foster, property owner Falling Branch area, asked for more information
pertaining to the proposed Comprehensive Plan Amendment. She asked what the proposed zoning will be? Mr. Powers explained that the proposed amendment is not a rezoning. The amendment proposes how the Plateau and Creek area are anticipated to be developed in the future. Mr. Davis showed a map designating the Plateau areas that would have commercial and/or industrial development. The Creek Area will remain residential.
Mr. Joe Conrad stated the he would like more information on how the amendment
would change the status of the land. Mr. Powers explained that the proposed Comprehensive Plan Amendment is not changing the zoning. It will only change the Comprehensive Plan as to how development will be made in the next couple of years.
Mr. Robert Metzler asked how the amendment would affect Hazelnut Road?
Mr. Powers stated that area is low density residential and will remain the same.
There being no further comments, Mr. Green closed the Public Address session.
APPROVAL OF AGENDA:
On motion by Don Linkous, seconded by Malvin Wells and unanimously carried,
the agenda was approved as distributed.
OLD BUSINESS:
William M. Flinchum Rezoning & SUP Request:
On motion by Kitty Brennan, seconded by Harry Neumann and unanimously
carried, the William M. Flinchum Rezoning and Special Use Permit request was opened for discussion.
Mr. Draper said Mr. Flinchum runs a good clean operation and he would support
the request. Mr. Neumann asked when the original permit was issued? Mr. Flinchum said it was issued in 1985 for a garage and maintenance shop. The fact that Mr. Flinchum works on race cars as a family hobby was brought up. Mr. Keesee said this could be discontinued if it was a problem. Mr. Scott stated that as long as the work is done as a family hobby and not commercial, it was in conformance with the zoning ordinance. The draft proffers in the Gay Engineering letter of May 13, 1998 were discussed. Mr. Linkous said he felt this request was not in conflict with the Comprehensive Plan and has no adverse effect. Discussion followed concerning the proffers and conditions proposed for this request.
On motion by Joe Draper, seconded by Don Linkous and unanimously carried, the
William M. Flinchum Rezoning request to rezone 0.6359 acre; a portion of Tax Parcel No. 29-A-8 from A-1 (Agriculture) to M-1 (Industrial), with a Special Use Permit for a contractorÕs storage yard is found not to be in conflict with the Comprehensive Plan and recommended to the Board of Supervisors for approval provided (a) the draft proffers are formally made to the Board and (b) the Special Use Permit include the following two conditions:
1. This permit is to allow operation of a contractorÕs storage yard (outside storage of heavy equipment). In accordance with Section 10-532 of the Zoning Ordinance, this permit shall automatically become void if the property is not used for this purpose for a period of two years or more.
2. A plan for providing the screening required by Section 10-473 of the Zoning Ordinance shall be submitted within 90 days of the date of approval of this permit. Installation of the required screening shall be complete within 180 days.
Property is located on the north side of Panorama Drive, in the Mt. Tabor
Magisterial District.
Stratford Group, Inc. Rezoning Request:
On motion by Don Linkous, seconded by Kitty Brennan and unanimously carried,
the Stratford Group rezoning request was opened for discussion.
Ms. Brennan asked if this request was part of a boundary adjustment? Mr. Scott
explained that the Stratford Group owns land which they wish to develop as a residential subdivision. In order to acquire land needed for the access road to the subdivision, they have proposed a land swap with Edwin Fast, an adjacent landowner. This request needs to be approved along with the Edwin B. Fast request to rezone 0.66 acre from A-1 (Agriculture) to R-1 (Residential. Together, the two requests align the zoning with the new boundary lines.
On motion by Don Linkous, seconded by Richard Daub and unanimously carried,
(Joe Draper, abstaining), the Stratford Group, Inc., request to rezone 0.936 acre; a portion of Tax Parcel No. 52-A-22, from R-1 (Residential) to A-1 (Agriculture) is found to be compatible with the Comprehensive Plan and recommended to the Board of Supervisors for approval. Property is located on the north side of Prices Fork Road, approximately one-half mile west of the Blacksburg Town Limits, in the Prices Fork Magisterial District.
Mr. Wells left the meeting at 7:45 p.m.
Falling Branch Comprehensive Plan Amendment:
On motion by Don Linkous, seconded by Kitty Brennan and unanimously carried,
the Falling Branch Comprehensive Plan Amendment was opened for discussion.
Members discussed the amendment. They felt that major changes are coming
to the Falling Branch area due to the construction of the full cloverleaf interchange with Interstate-81 and the development of an industrial park. The county needs to anticipate these changes and address them in the countyÕs Comprehensive Plan.
On motion by Joe Draper, seconded by Richard Daub and unanimously carried,
the proposed Falling Branch Comprehensive Plan Amendment is recommended to the Board of Supervisors for approval.
There being no further business, on motion by Joe Draper, seconded by
Don Linkous and unanimously carried, the meeting was adjourned at 7:55 p.m.
