Mr. Heavener read the request.
Mr. Sandy presented photos and explained the Smiths were planning
on expanding a nonconforming use by replacing a single wide manufactured home
with a double wide.
Mr. Heavener opened the public hearing.
Mr. Rob Kesling, Luv Homes, stated the Smiths were trying to upgrade
their current living conditions. After being questioned by Mr. Heavener, Mr.
Kesling stated the manufactured home dealership did not realize the singlewide
was a nonconforming use and thought the replacement would be allowed.
There being no further comments the public hearing was closed.
Mr. Reilly confirmed with Mr. Kesling the applicants would receive
a complete refund of the money they had paid if the request was denied.
Mr. Reilly made a motion to deny the request; however, the motion
failed due to the lack of a second.
Mr. Heavener stated the request was not a detriment to the surrounding
area; however, he felt the setbacks should be met. He noted a concern over the
increasing number of requests being submitted after the fact.
Mr. Sandy and Mr. Kesling confirmed the proposed home site could
be shifted and arranged so all setbacks could be met.
On motion by John Surface, seconded by Richard Barnett and
carried by a vote of 4-1 (Reilly opposed), the Montgomery County Board of Zoning
Appeals approved the Vance E. & Linda E. Smith Variance Request to permit
the placement of Manufactured Home, Class A (2 section manufactured dwelling)
to replace an existing Manufactured Home, Class B (1 section manufactured dwelling),
with the following condition:
1.) The Manufactured Home Class A (2 section manufactured
dwelling) must meet all setback requirements set forth in the Montgomery County
Zoning Ordinance.
The property is identified as Tax Parcel No. 121-A-24A (Account
ID No. 032880), 4125 Pilot Road in the Riner Magisterial District.
Mr. Sandy stated that the current by-laws needed to be amended
to reflect the recent changes regarding the meeting date and the use of alternate
members.
Mr. Eckel asked the following changes be made:
A. 1-1 Strike Elect the Secretary
B. 2-3 Correct spelling
On a motion by John Surface, seconded by Doug Eckel and carried
on a 5-0 vote, it was agreed that the By-Laws would be approved as amended.
