Montgomery County government includes two attorneys' offices: and three courts:

Commonwealth's Attorney

Commonwealth's Attorney Brad Finch serves as the Chief Law Enforcement Officer for the County, prosecutes all felonies and certain misdemeanors and traffic offenses, and advises citizens, law enforcement agencies, and magistrates regarding interpretation of criminal law.

The Commonwealth’s Attorney’s Office prosecutes criminal cases on behalf of the citizens of Montgomery County. This office does not handle civil cases such as divorces, landlord/tenant disputes, estates, wills, real estate, etc.

County Attorney

County Attorney Marty McMahon represents and counsels the Board of Supervisors, County staff, and County Boards and Commissions on all legal and civil matters involving County government. The County Attorney defends or brings action in which the County and/or any of its boards, departments, agencies, officials, or employees is a party, and prepares all leases, bonds, deeds, and contracts in which the County is a party.

Circuit Court

Circuit Court Clerk Erica Williams serves as general record keeper for the County, records land transfers, deeds, mortgages, births, wills, adoptions, divorces, military records, and election results. The Clerk issues fishing, hunting and marriage licenses, and applications for passports, name changes, notaries, and concealed weapons, selects and seats juries, and keeps court judgment document books. Birth and death certificates are handled by the Health Department (540-381-7100).

Deeds and other land-related filings
A specific cover sheet, completed by the filing attorney, must be included for all land-related filings and recordings, including deeds, deeds of trust, releases, and assignments. The cover sheet is available online. There is no additional charge for this requirement.

Circuit Court services
Circuit Court Case Information
You can look up cases in all Virginia jurisdictions with Virginia's Judicial System website. Follow the instructions below. All links open in a new window.

  1. Go to the Circuit Court Case Information Pilot Project page.
  2. Select the court locality from the drop down list, then click the "Begin" button.
  3. Choose the type of case (e.g., criminal, law, etc.), then click the "Continue" button.
  4. Search for a particular case by name, case number, or date.
  5. When finished click the "Logoff" button.

General District Court

The General District Court hears:
  • civil and traffic cases involving amounts under $10,000
  • suits involving misdemeanor crimes
  • preliminary hearings on felonies
  • commitments for the mentally ill

Juvenile and Domestic Relations Court

The juvenile and domestic relations district court hears all matters involving juveniles such as criminal or traffic matters. Juvenile delinquency cases are cases involving a minor under the age of 18 who has been accused of committing an offense that would be considered criminal if committed by an adult. Other juvenile offenses may be referred to as status offenses. Status offenses are those acts that are unlawful only because they are committed by a minor.

In addition, this court handles other matters involving the family such as:

  • custody
  • support
  • visitation
  • family abuse cases
  • cases where adults have been accused of child abuse or neglect
  • criminal cases where the defendant and alleged victim are family or household members
