Circuit Court - Services
*Please note: Accepted forms of payment by phone are Visa/Mastercard but in person we take cash, local check, U.S. money order and Visa/Mastercard for criminal payments.
Business Name Registration
Partnerships, fictitious names, and assumed names may be registered within
the Circuit Court Clerk's Office for a fee of $10.00 and an additional $1.00
for more than two partners.

Concealed Handgun Permit
The following are steps that you need to complete in order for the
Sheriff's Office to file the necessary report with the Circuit Court
of Montgomery County, Virginia. Please complete these steps in order.
- Obtain a concealed handgun permit application
(Virginia State Police
Form SP-248: Application for Concealed Handgun Permit) from the Clerk of Court
OR download from one of the links below.
Fill out and return to the Clerk of Court with the $15.00 application fee.
Please have the proof of training form attached, pursuant to Virginia Code 18.2-308(G).
- The Judge then returns his decision to the Clerk of Court's Office, who
will then notify the applicant, pursuant to Virginia Code 18.2-308(D).

- Submit a request letter with any information that will help us find your documents. Information such as full names, dates, and (if known) book and page numbers are very helpful.

- Include a check or money order for enough money to cover the costs of copy and certification fees. Our copy fee is .50 per page (typically wills and orders are more than one page), and our optional certification fee is $2 per document. Please specify if you would like the document(s) certified.
- Make checks payable to Erica W. Williams, Clerk. No refunds can be given.
- Please send a self-addressed, stamped envelope with your request. If you have requested multiple documents, please place enough postage on the envelope to cover the cost of mailing. Typically, first class postage covers the first five pages. If your documents are more than five pages please include an additional stamp.
Instructions For Getting A Marriage License

- Both the groom and bride must be present.
- Both parties must be 18 years of age or older. ( if under 18 must
have parent or legal guardian present)
- Both parties must have a form of identification.
- There is no waiting period for the license. ( you apply for and
receive the license the same day)
- The cost of the marriage license is $30.00.
- The license must be used within 60 days from the date of purchase.
- The license must be used within the state of Virginia.
- Marriage license office hours are from 8:30 a.m. to 4:00 p.m.
The minister or other officiant who performs the marriage ceremony must
complete the bottom part of both the original and the copy of the marriage
license Form VS-3, and return both to the clerk's Office of Montgomery County
Circuit Court within five days after the ceremony. The attached self-addressed
envelope can be used for mailing.
The "Certificate of Marriage" should be completed by the officiant and
delivered directly to the married couple for their personal retention. This
is not the license and it is not a court record, but it contains much of the same
information provided on the license.
The marriage license returned to the clerk's office is retained permanently,
one copy by the court and one copy by the Virginia Division of Vital
Records. If the married couple needs a certified copy of the license for social
security, the division of Motor Vehicles, or for any other purpose, it can be obtained
from the clerk's office. The cost is $2.50 per copy. You may request it in person
or by mail. If the request is by mail, please state your full names and the
approximate date of marriage and provide a stamped self-addressed envelope. Mail your

Anyone who changes his or her name should get a new Social Security Card.
The Social Security Administration provides this service at no cost.
Future income tax returns might be delayed if the name on the tax form does not match the
name on the social security card. Social security forms are available at the post office.
Your marriage license is valid for a period of sixty days. If the
ceremony is not completed within that time, then the unused license must be returned to
the clerk's office. The clerk must report annually to the Commonwealth's Attorney
any unaccounted for licenses issued during the prior year.
Notary Public Requirements
- Many changes (including electronic submission of notary application directly to the Secretary of the Commonwealth) will be coming July 1, 2008.

Passports

First Time Passports (Application Form)
- A certified copy of your birth certificate from the vital
records department of your birth state.
- Two passport photos. (same pose)
- One check or money order made out to U. S. Department of State.
($67.00 for adults or $52.00 for 15 years of age or younger)
- One check or money order made out to Clerk of Circuit Court
(cash also accepted for this fee). ($30.00 for all ages)
- A photo I. D. for verification.
Time period for the return of this passport is 6-8 weeks after applying.
How to Apply for a Passport for a Minor Under Age 14
Renewal Passports (Application Form)
- Must have been 16 years of age or older when you applied
for the original passport.
- Adult passports are renewable only if the issue date of the
original passport does not exceed 15 years.
- This is a procedure that you handle yourself. (the Clerk's
office does not assist you in this procedure)
Expedited Passports
- Everything that is needed for a first time passport is also needed
for an expedited passport.
- Also needed is two overnight, prepaid envelopes from the post office.
- An additional fee of $60.00 needs to be added to the fee for the
U. S. Department of State.
Probate of Wills

If a will exists, we require the original will and a copy of the death certificate.
An appointment is required. No walk-ins please.
